According to the boy's parents, the officer pulled up to their house in full uniform, told the boy he was going to arrest him for sexual assault and threw the cuffs on him.

He later took the cuffs off and left with a warning, but the boy's parents complained, claiming the officer abused his power.

ABC7 legal analyst Dean Johnson says while the officer actually had the authority to arrest the boy for statutory rape, this is a gray area.

"If it's not technically a crime, if it's not say assault under color of authority, at the very least it was an unwise move. Any time a police officer is personally involved in the case where a relative or close friend is a complaining witness or a party to the case in any way, the best practice would be for the police officer to refer it to another investigator," said Johnson.

After the parents complained, police arrested the boy for real and charged him with having unlawful sex with a minor.

The Mercury News also reports that the officer's step-daughter was also cited for having sex with a minor.

Tuesday night, the officer's lawyer Terry Bowman said, "The officer was essentially invited to use 'scare straight' tactics and there were no objections to the lecture or the handcuffing. Everything was done in the spirit of reaching a troubled young man who is heading down the wrong path."

The identities of the adults are being withheld to protect the identities of the minors.

Meanwhile, prosecutors are looking into the possibility of charging the officer with false imprisonment.




I think that is horrible. That's a very good way to mess two kids up for life.

shouldve lef it at the warning and had a serious converation with their son. I wonder if these are the types of parents that want to be the kids buddy rather than parents?

Oh, and agree with Joe Bananas on this. These parents are douches as well IMO.

I had a bad experience at the age of 15 with a situation like this. No police officer involved, but a very angry father. He sat me down, with my parents and basically told me that he would hurt me if I ever used this situation against his daughter. It was pretty much….keep your phuckin mouth shut about this & stay away from my daughter.

My dad, who is a beast, sat and listened, didn’t say a word. I assume to this day, he thought the same damn thing and if this would have been switched, being one of his two daughters, he may have already taken it further.

Long story short, he did not complain or say you will not talk with my son like that bla…bla…bla…


Of course this dad could have maybe handled this better. He probably shouldn't be using his position as a police officer to take care of personal business. But in the grand scheme of things....Christ we have become a society of pu$$ies that complain about the smallest little things.

Yea, the chances are slim that these kids have any kind of healthy outlook about sex even into adulthood now.

I don't think that a police officer pretending to arrest a kid isn't "the smallest little thing."

And now the police officer's daughter is charged with a sex crime too.. congratulations, douchebags. A conversation would have sufficed, first with the parents, then with the kids. But no, this cop wanted to throw his weight around and be a tough guy...

At the VERY least, he should have spoken to the parents.

That's how I feel about it, anyway.

A man's home and family is sacrosanct, and you don't come into a man's home and disrupt his family like that. You don't make a man feel helpless to protect his child in his own home like that.

Again, if these kids are messed up over this....tough luck, raise tougher kids...

No. The boy is 15, the girl is 14. He was not raping her. (though I think it's technically statutory???) that doesn't give him the right to intimidate another man in his own home and threaten his kids. All the while hiding behind his badge.

I have a 2 year old son. In 13 years, if he makes the mistake of getting involved in a sexual relationship with a 14 year old girl, or ANYONE, I expect, out of courtesy, for the parents to contact me and for all of us to have a rational and calm talk about the situation. You don't come into my home and dominate my family like that.


You really don't see how shaming two kids for doing something that is, after all, natural and causing a lot of embarassment over this could damage their sexuality? Really? Ok then. I disagree. i think an incident like this will F a person up for a long time. It has nothing to do with being "tough." Tough kids will just hide the damage better.

That is how I feel about it.

I'm phucking confused. This article is written HORRIBLY.

Did the girl's mother or biological father file a complaint with the police station, or did the step-father find out privately? It sounds like there was a real complaint filed by police before the incident (they kept referring to it as an actual case), and the step-dad didn't do the proper thing and take himself off a case where he's personally conflicted. But it sounds like police would have showed up in some form anyway.

Obviously, the mature, responsible thing would have been to all get together--parents and kids--and let them know in no uncertain terms that sex at their age isn't acceptable. But they aren't the first parents to handle their kids having sex poorly and surely won't be the last.

As a police officer, he messed up--and should be punished accordingly--but I can't fault a man for putting his family above all else (as he should). I don't have a 14 year old daughter; if I ever do, lord help the idiot dumb enough to have sex with her.

Nope, I didn't miss that. He also has the duty to arrest his own daughter if the boy's parent's complained. Which they then did, now she's under arrest too. congratulations cop, well done. I guess people don't like being intimadated by a badge in their own home with their own child.

If the cop did not talk to the father of the boy first and had an agreement to do this, then it IS a home invasion, in my opinion. He didn't scare a horney kid, he came into another man's home, made him sit there, cuffed his child, and intimated the family.

Instead of talking to the father and everyone talking to their kids together.


JV, here's the timeline, as I understand it, from that article and the news and other sources:

15 year old dates 14 year old girl
they start banging
the girl's step father finds out. He is a cop
the cop step father goes to the boy's house, makes his father sit down and watch this, (the boy's father recorded it on his cell phone) while he "arrests" the kid and tells him he is going to be charged with sex crimes.

Then he lets him go.

The parents of the boy file a complaint.

This results in charges against the girl too, because apparently the law there is so f'ed up that two underage kids having sex is a crime on both parties.

Not when you wear a badge. If you make the choice to put your ego above your duty, then you should face the consequences. he didnt' "put his family" ahead of his duty... he could have talked to the father of the boy first, and this could have been done without a badge being involved at all.

Let's not forget, this boy is FIFTEEN. Not 21, not 19, not even 18. he's a child himself. MONTHS apart from the girl.

What a epic waste of taxpayer time and money.

Is anyone shocked that a 14 and 15 year old were doing this?

Should the father/cop be held accountable? Probably

Should the kids be prosecuted? I don't think so.

If I ever have a daughter, I'm going to do things the right way: when she's 12, I'm going to attempt to rob a bank by throwing my own feces at the tellers and security guards, serve my 2 years in jail, get a neck tattoo or 7, and every punk high school jock will know me as Megan's crazy ass father and good sense will tell them to keep their dirty little hands off.
