I know I posted the original case a while back....Bandwagon is starting to roll.
I have mixed feelings about this particular law.
New Illinois Rape Law Protects People Who Change Mind During Sex
Tuesday, July 29, 2003
SPRINGFIELD, Ill. — A new rape law in Illinois attempts to clarify the issue of consent by emphasizing that people can change their mind while having sex.
Under the law, if someone says "no" at any time the other person must stop or it becomes rape. The National Crime Victim Law Institute (search) said it believed the law is the first of its kind in the country.
Lyn Schollett, general counsel for the Illinois Coalition Against Sexual Assault (search), said the law was important to make it clear to victims, offenders, prosecutors and juries that people have the right to halt sexual activity at any time.
"I think it will empower prosecutors in charging cases where the victim and the offender have a sexual history," she said.
But the director of the Victim Advocacy & Research Group (search) in Boston said it would be hard to imagine courts not upholding a woman's right to withdraw consent.
"To me, it's demeaning," Wendy Murphy said. "It's like the old saying: 'If it ain't broke, don't fix it.' I don't think it was broke."
The law was inspired by a California case involving two 17-year-olds who had sex at a party. The girl changed her mind about having sex, but the boy did not stop immediately.
He was charged with rape, and it took years for the courts to decide that he could be found guilty under California law. The California Supreme Court ruled in January that a man can be convicted if a woman first consents but later asks him to stop.
Lawmakers said they wanted to avoid the same kind of long legal battle in Illinois. Gov. Rod Blagojevich signed the law Friday but did not announce it until Monday. |

So, dangle a steak in front a dog, then say, "psych"!
I'm not saying the law is wrong, but damn, I'd hate to be in that position. But, regardless, if/when a woman says "no", it means pack it up, go home and take care of business there.
The law can be used as a weapon though, by a woman that was just hurt. She could be vindictive about the situation and yell "rape". It happens a lot, and with this new law, it will happen a lot more.
I'm not saying I'm right...it's just my opinion right now. I could be way off here. _________________ my demo reel

That's rough, but I guess still fair. People can use rape laws now as a weapon if you think about it. The Kobe Bryant case is a perfect example, who knows which person is telling the truth? There are sources which support the idea that the girl consented to sleep with him & then claimed rape afterwards.
Sex is always a mess, just wait 'til you're married, then you're not allowed to sleep with anyone else!  |

Jumalian & Jester ~ That's exactly what I don't like about this.
I've been around some females who are/have vindictive and malicious enough to do just that.
This law is one sided by the definition of Rape. |

Unfortunate Dlady, but I do agree with Jumalian. When the word 'No' is uttered, it's "stop right now". Do not pass go, do not collect $200.00.

One more attempt at people passing laws to remove personal accountability. Nobody wants to have to take responsability for their actions. You know as well as I do that people dont SUDDENLY change their mind half way through. Its just a legal way for women, who do something they regret later, of passing the blame.
I realize that we all have the freedom of choice at anytime, so in theory, this law has merrit. However in reality, the decision was made LONG before. Buyers remorse is not rape. |

Wow, this law makes it a lot easier for guys to get raped. Think about it: A guy is having sex and suddenly thinks of his wife, kids, mom, girlfriend, or whatever and wants to stop but the girl is really into it. He says to stop. She thinks he must be kidding. RAPE!
Seriously, this is kind of ridiculous. I think if the girl physically tries to leave and is restrained by the guy, it could be regular assault maybe. But none of this, "I said, 'No,' and he didn't stop." crap. Just like communism, theoreticlly it could work. I think that this is one of those laws that just doesn't work in the real world. Yeah, that's my biggest problem with this. Not that it's my only problem with it. And then who's word do you believe? The guy who says he stopped right away, or the girl who says he didn't. It's really leading to a situation or case where the girl changed her mind and then wanted it to be "retroactive" and to never have had sex with the guy at all.
Having condoms come packaged with a consent waiver is really the next step. Actually, didn't I already hear about something like that where the condom comes in a package where the wrapper retains fingerprints and you're supposed to give it to the girl to open or something? And by opening it she is consenting?
Really, if you think about it it's all kind of ridiculous. Either that or it just shows how poorly I understand the female mind. (which I don't doubt) So this law basically applies to girls who ended up naked with a man by consent but weren't really sure if they wanted to have sex or not. Does this happen often in a situation where the girl is not trying to get the guy in trouble? Does this happen often at all?

HAHA, its the only way to be safe.
I had a good friend ALMOST get charged with a rape, but it was total BULLSHI T!!!
We were at another friends house, the two were all over each other all night, so they ended up going back to his place..DUHHH!! She was smiling an kissing him on teh way out the door.
So the next day he takes off to florida to go back to school, he said they had a great time, and well other stuff I wont say. But yes, they procreated like two dirty dogs. Then a few days later, I hear she was charging him with rape and stuff, and abunch of BS that NO way in hell my friend would do. So I called him up in Florida (We were in Corpus Christi at the time) and told him what was going on....he about dropped a load when I told him. Well to make a long story short, what happed was she was still living at home, she didnt come home that night, and instead of fessing up to her dad that she was partying and drinking, she made up the story about the rape so she wouldnt get in trouble. So then her Dad went on a rampage, he had teh sheriff and poilice talking to people around campus. It was serious stuff, then a few days after that, she finally broke down from the pressure and confesed to making it up b/c she didnt want to be grounded.

Hey, maybe it'll give people a reason to not sleep around with any skank...because it's definitely going to get abused.
I agree, it's going to get very messy...with the whole timing issue. The girl could easily say that the guy wouldn't stop, even if it was mere seconds later. |

Yeah, but this one includes a little more than just the fingerprints. But then again, according to this new law the initial consent probably wouldn't mean anything if she changed her mind halfway through the act. _________________ How do you apologize to a friend for something like that? It doesn't even need the 'new' law for that. Initial consent doesn't mean squat! At any time, if the gal says stop or no, that's it.
Quit there, go no further. Get your clothes back on, do NOT say a word, leave, don't ever talk to the person again. Go home immediately. Throw the chicks number away, after drenching it in acid and burning it.
If she wants to discuss it in any way, threaten a law suit against her or at least a 200 yard restraining order.

Scary scary world we live in.
What if there's music blaring in the background? What if there's too much noise from the bed and you don't hear it?
