Instead, he focused on the narrower question of whether the collective bargaining agreement between the N.F.L. and the players union gave Goodell the authority to carry out the suspension. Judge Berman ruled that it did not.
An underinflated football would be easier for a quarterback to grip and throw. New England won the game in question, the A.F.C. championship game, against the Indianapolis Colts, 45-7, scoring most of its points in the second half after the Colts had complained about the balls.
Brady’s lawyers had argued that the N.F.L. did not warn him that he could be suspended for not cooperating with the league’s investigation, as a report commissioned by the N.F.L. asserted, or for playing a role in tampering with equipment, something that normally warrants a fine. Brady had denied any knowledge, but the N.F.L. report said the preponderance of evidence made it likely he knew about the balls.
Judge Berman’s ruling is a blow to Goodell, who has tried to expand his authority to suspend players for what he perceives to be violations of the integrity of the game.
Unless the N.F.L. can get a federal appeals court to issue an emergency injunction, Brady will play in the Patriots’ opening game Sept. 10 against the Pittsburgh Steelers. |
IOW: The NFL cannot compel players to cooperate with an investigation, or better yet, cannot suspend them for failing to cooperate. Precedent is a bitch Roger. But you knew that, with your law degree and all. _________________

aubs is stuck in jury duty all day today. poor girl is locked in a courtroom while brady is free to play and about to get a divorce. lord only knows what's going through her mind... uh what? yeah, guilty! can we go now? |

LOL at that stuff. The Patriots are just trolling now. Nobody will ever be able to prove they orchestrated something like the radio broadcast so why not do it? I think it is one of the funniest things a team has done to troll the commissioner in any sport, at any time. _________________

jt09, as much sense as it makes financially for Davis to make that move, it makes no sense for their fan base. The Raiders and all the garbage that accompanies them is here.
Would San Antonio embrace them, or just use this as an easy opportunity to see the visiting teams? I'm guessing there would be little/no home field advantage for a long time. And if/when the 'Boys come to town fuggetaboutit, right?
The Raiders just need to move to Levi Stadium with the 9'ers. There is absolutely no good reason to not make that happen at this point. _________________

i've been avoiding the threads on longhorn/bobcat boards about it for the most part, but there's a lot of smoke around it. apparently red mccombs has been in touch w/ mark davis and there is a plot of land purchased somewhere just north of sa for a stadium, just waiting for the ok.
would sa embrace them? my guess is yes, overall. while sa is absolutely cowboys territory for sure, it's also the largest city in the country w/o a team, now that la has been checked off. there's tons of opportunity there. |

The city size is one thing, but aren't they like a mid-30's media market?
Just checked - 32 according to Nielsen. That has to be a pretty big issue, especially considering the Raiders get the SFBay (6th) + Sacramento (20th) area as their immediate home market. I guess you could throw Austin in there with SA but that's still not a huge overall market.
Anyhow, at this point the Raiders options are getting pretty slim and Davis is likely getting tired of playing these games. Moving them would be very painful for many though (unlike STL who lost something they should never have had) NorCal is their home and their fan base is very deep here. _________________
