The judge invoked the Billy Madison bitchslap:

U.S. District Judge John G. Heyburn II wrote:
"These arguments are not those of serious people," wrote US district judge John Heyburn. "Though it seems almost unnecessary to explain, here are the reasons why.

"Even assuming the state has a legitimate interest in promoting procreation, the Court fails to see, and Defendant never explains, how the exclusion of same-sex couples from marriage has any effect whatsoever on procreation among heterosexual spouses. Excluding same-sex couples from marriage does not change the number of heterosexual couples who choose to get married, the number who choose to have children, or the number of children they have.

"The state’s attempts to connect the exclusion of same-sex couples from marriage to its interest in economic stability and in 'ensuring humanity’s continued existence' are at best illogical and even bewildering…The Court can think of no other conceivable legitimate reason for Kentucky’s laws excluding same-sex couples from marriage."

couldn't care less if homosexuals want to marry.

One thing that I have wondered though, and haven't heard anything about is consequences to Gov't revenue via estate taxes. I don't think it is out of the realm of reality to have "sham" gay marriage to move property from one individual to another without taxation. Maybe it is so small no worry.

Well L&C was healthcare, but same idea i guess. I was getting more at a late life situation.

Agreed you could(hetro), but it doubles the possiblilties, right?

I don't think either side will care about "marriage" in 20 years. A friend of mine from college just got gay married and says it makes zero difference in his relationship and only did it for legal benefits. He agrees that the government should be out of the "marriage" game and all couples should get legal civil unions. Let churches perform "marriage" ceremonies if they like. I have a feeling once marriage is no longer a dangling carrot in the homosexual community, and they see its not a life changing thing, there will be less push state by state. I think people will just go get it where they can and be done with it.

What a coincidence! I just got "hetero" married at the end of May solely for legal benefits, and to make sure that if my wife died, there is ZERO possibility that my inlaws can try to take my kids from me.

Otherwise, changed nothing. Oh, and now I'm on her insurance, which is much better than mine. Could have switched without being married, but I think there was more paperwork involved.


No religion is involved in our marriage.

Estate taxes are not the most popular tax in the world and are continually either made more lax or the exemptions are increased. The federal exemption is over 5 million I believe, and many states have no estate tax or big exemptions as well. The bigger loss to government would likely be more couples choosing to file their taxes jointly. I would also imagine more married couples means more people taking care of another person and perhaps less public assistance therefore, but that is pure conjecture.
